Mumbai: on Monday, a special court rejected actor Fardeen Khan`s plea seeking an amendment of the chargesheet filed against him in cocaine seizure case of May 2001. On June 1, Fardeen had appealed a Sessions Court in Mumbai to amend the chargesheet, claiming he was buying just one gram of cocaine when the Narcotics Control Bureau arrested him. The petition of the actor assumed significance as in their chargesheet the police have said they recovered nine grams of cocaine from Fardeen and drug peddler Naseer Abdul Karreem Khan.
Nasir had also stated that although he had nine grams cocaine, Fardeen had come to buy only one gram and remaining eight grams were for another buyer.
Fardeen`s lawyer, Aiyaz Khan, earlier had said that such specification was very crucial in the case, as punishment varies according to the quantity of drug found on accused.
Possession of one gram of cocaine amounts a six-month jail sentence, whereas possession of two grams or more can lead to a rigorous imprisonment of 10 years or even more under provisions of Narcotics and Psychotrophic Substances (NDPS) Act. While buying cocaine from Nasir, Narcotics Control Bureau (NCB) arrested both Khan and Nasir in May 2001.
Fardeen was later granted bail.
